Your Social Voice LLC, User Agreement This User Agreement ("Agreement" or "Terms and Conditions") is an agreement between Your Social Voice, LLC ("Your Social Voice" or "YSV") and the party set forth in the related Registration Form ("User" or "You" and "Your") incorporated herein by reference (together with any subsequent Registration Forms or other online signup, acceptance or order form submitted by User, the "Registration Form"), and applies to the purchase of all services ordered by User on the Registration Form (collectively, the "Services"). As used herein the term "User" and "You" shall also include any and all users, Customers, subscribers, affiliates (including without limitations Users or non-Users to whom Your Social Voice provides links or banners to promote the services or products of Your Social Voice or any third party the services or products of which are offered by or obtained through or in connection with Your Social Voice), resellers or others (i) who sign up for, use or obtain services or products from Your Social Voice or from any third party services or products of which are offered by or obtained through or in connection with Your Social Voice, or (ii) who visit the Web sites of Your Social Voice or of any such third party. PLEASE READ THIS AGREEMENT CAREFULLY. SIGNING UP FOR THE SERVICES CREATES A CONTRACT BETWEEN YOU AND US, CONSISTING OF THE ORDER, THE APPLICABLE SERVICE DESCRIPTION AND THIS USER AGREEMENT. YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT AND ALL TERMS AND CONDITIONS INCORPORATED BY REFERENCE IN THIS AGREEMENT, INCLUDING OUR ACCEPTABLE USE POLICY. YOUR USE OF THE SERVICES CONSTITUTES ACCEPTANCE OF THIS AGREEMENT.  Acceptable Use Policy YSV does not intend to systematically monitor the content that is submitted to, stored on or distributed or disseminated by User via the Service (the "User Content") or RSS feeds that YSV incorporates with User's social networking sites. User Content includes content of User's and/or users of User's social sites. Accordingly, under this Agreement, You will be responsible for Your user's content and activities on Your social sites. Notwithstanding anything to the contrary contained in this Agreement, YSV may immediately take corrective action, including removal of all or a portion of the User Content, disconnection or discontinuance of any and all Services, or termination of this Agreement in the event of notice of possible violation by User of the AUP. In the event YSV takes corrective action due to a violation of the AUP, YSV shall not refund to User any fees paid in advance of such corrective action. User hereby agrees that YSV shall have no liability to User or any of User's users due to any corrective action that YSV may take (including, without limitation, suspension, termination or disconnection of Services). YSV posts content from RSS feeds. Such feeds and or posts will not be regularly monitored by YSV. Should the User feel the RSS content is not suitable, they may contact YSV via email or phone to have the content removed. By accepting this User Agreement, User acknowledges that YSV may post anything to the User's social networking sites that have been created by YSV. The User does not have any control or administrative privileges for their social networking sites that have been created by YSV. Changes of Terms of Use Your Social Voice reserves the right, from time to time, with or without notice to the User, to change this User Agreement in our sole and absolute discretion. The most current version of this User Agreement can be reviewed by visiting our website and clicking on "Terms and Conditions" located on the menu bar. The most current version of the User Agreement will supersede all previous versions. Billing User may request the specific details regarding the User's membership with YSV at anytime by emailing YSV directly or filling out the contact form on YSV's website. The User must fill out the contact form or email in a manner which specifically states that the User is requesting their details of membership. Your Social Voice offers three different payment options. The User must select the payment option prior to submitting payment. The service begins when the payment from the User is received by Your Social Voice. To select payment, User must read Terms and Conditions. User must then click on the Agree and Buy Now button located under the Terms and Conditions. All payments must be submitted through PayPal by credit card or PayPal account. Once User's payment is successfully received by YSV, the User will not be entitled to a refund of any amount. Your Social Voice will only issue a refund if the User's account is canceled or terminated by YSV and YSV agrees to refund the User. All refund amounts are in our sole and absolute discretion. Payment Options 1. Option 1 ("Annual Payment" or "Yearly Payment" or "Best Value"). By selecting Option 1, User agrees to a 12 month (1 year) term of service. User must submit payment of $300 USD (three hundred US dollars) to YSV prior to activation of service. The 12 month (1 year) term begins the same day User submits payment of $300 USD to YSV. By submitting payment and agreeing to User Agreement, User is not entitled to any refunds or reimbursements. The service provided by YSV is automatically renewed for another term equal to the prior term of service. YSV will automatically bill User for $300 USD upon completion of their previous term of service. The User must submit a request to cancel service prior to the end of the User's 12 month (1 year) term. USER MUST SUBMIT REQUEST FOR CANCELLATION OR TERMINATION IN WRITING TO YSV PRIOR TO END OF TERM OF SERVICE. Failure to promptly cancel renewal of service will result in equal billing and term of service as previous term. User agrees to inform YSV of any changes in billing information prior to end of term of service. 2. Option 2 ("Semiannual Payment" or "Six Month Payment" or "6 Month Payment"). By selecting Option 2, User agrees to a 6 month (six month) term of service. User must submit payment of $170 USD (one hundred seventy US dollars) to YSV prior to activation of service. The 6 month term of service begins the same day User submits payment of $170 USD to YSV. By submitting payment and agreeing to User Agreement, User is not entitled to any refunds or reimbursements. The service provided by YSV is automatically renewed for another term equal to the prior term of service. YSV will automatically bill User for $170 USD upon completion of their previous term of service. The User must submit a request to cancel service prior to the end of the User's 6 month term. USER MUST SUBMIT REQUEST FOR CANCELLATION OR TERMINATION IN WRITING TO YSV PRIOR TO END OF TERM OF SERVICE. Failure to promptly cancel renewal of service will result in equal billing and term of service as previous term. User agrees to inform YSV of any changes in billing information prior to end of term of service. 3. Option 3 ("Monthly Billing" or "Least Value Option"). By selecting Option 3, User agrees to a 6 month (six month) term of service. User must submit payment of $30 USD (thirty US dollars) to YSV prior to activation of service. The 6 month term of service begins the same day User submits payment of $30 USD to YSV. $30 USD will automatically be charged to the User via their initial method of payment (credit card or PayPal account). By submitting payment and agreeing to User Agreement, User is not entitled to any refunds or reimbursements. The service provided by YSV is automatically renewed upon completion of the 6 month ("initial term"). The User will automatically be billed for each month in which YSV is providing the User service. The User must submit a request to cancel service prior to the end of the User's current term. USER MUST SUBMIT REQUEST FOR CANCELLATION OR TERMINATION IN WRITING TO YSV PRIOR TO END OF TERM OF SERVICE. Failure to promptly cancel renewal of service will result in monthly billing and term of service. User agrees to inform YSV of any changes in billing information prior to end of term of service. Activation of Service The initial term of service begins when full payment is submitted to YSV. It is the responsibility of the User to provide YSV with accurate contact information for User. After full payment has been received by YSV, YSV will attempt to contact the User once within 72 hours by email and/or phone. YSV will make a total of two attempts to contact the User by phone. YSV will send 1 email to User only if all three attempts to contact User by phone has failed. User may respond to the email or phone calls. User may contact YSV directly by email, phone, or contact form at http://yoursocialvoice.com/contact. IT IS THE USERS RESPONSIBILITY TO PROVIDE YOUR SOCIAL VOICE WITH INFORMATION YSV DEEMS NECESSARY. YSV may inquire the User's website, contact information, billing information, or any other information YSV deems necessary. Failure to comply with YSV's requests for information may hinder Your Social Voice's ability to perform services. USER IS NOT ENTITLED TO ANY REIMBURSEMENT, REFUNDS, CANCELLATION, OR TERMINATION IF YSV IS UNABLE TO PERFORM SERVICE DUE TO USER'S FAILURE TO PROVIDE NECESSARY INFORMATION TO YSV. Right to Terminate YSV reserves the right to terminate or restrict your use of our service, without notice, for any or no reason whatsoever. How Our Service Works Your Social Voice provides a marketing service via Facebook and Twitter. Once YSV has received full payment for term of service, YSV will attempt to contact User for more information. Your Social Voice requires the website address for which the User would like to have linked to all social network site postings. Additionally, YSV may ask for pictures, contact information, or any other information in order to build Facebook and Twitter profiles. Your Social Voice will compile several RSS (Really Simple Syndication) feeds from a variety of sources. The RSS feeds are chosen by their similarity of content to the User's website. Your Social Voice reserves the right to select RSS feeds that are used in creating the social networking site posts. Your Social Voice does not monitor all posts to the User's social networking sites. Your Social Voice will create one Facebook and one Twitter account for the User. YSV retains full control of the Facebook and Twitter accounts that have been created for User. USER WILL NOT HAVE ACCESS TO LOGIN INFORMATION FOR ANY SITES CREATED BY YSV. User may contact YSV via email to request any changes to their Facebook or Twitter account. Upon termination of service, all Twitter and Facebook accounts created for User will be terminated. YOUR SOCIAL VOICE IS NOT RESPONSIBLE FOR ANY OF THE CONTENT ON ANY FACEBOOK OR TWITTER ACCOUNT IN WHICH YSV HAS CREATED. Your Social Voice's goal is to provide a service to increase the amount of hits the User has on their website(s). Your Social Voice is in no way responsible or liable for any change or no change in the amount of traffic to a User's website(s).
